سيارة كل 15 سنة.. إعفاء سيارات المعاقين من الضريبة الجمركية رسميًا (التفاصيل الكاملة).. أعلنت الحكومة حل أزمة سيارات المعاقين، حيث وافق مجلس الوزراء، برئاسة الدكتور مصطفى مدبولي، في اجتماعه، على مشروع قانون جديد يتضمن تعديل بعض أحكام قانون حقوق الأشخاص ذوي الإعاقة رقم 10 لسنة 2018، بهدف تعزيز حقوق هذه الفئة، وتوفير مزايا إضافية، مع تشديد العقوبات ضد المخالفين أو مستغلي الامتيازات دون وجه حق.
تعريف محدث للشخص ذي الإعاقة
شملت تعديلات قانون سيارات المعاقين تعديل المادة (2 فقرة أولى) لتعريف الشخص ذي الإعاقة بأنه “كل من يعاني من عاهة طويلة الأجل؛ بدنية أو عقلية أو ذهنية أو حسية، قد تمنعه لدى التعامل مع مختلف الحواجز من المشاركة بصورة كاملة وفعالة في المجتمع على قدم المساواة مع الآخرين”.

من أبرز المزايا التي تضمنها مشروع قانون الضريبة علي سيارات المعاقين ، تعديل المادة (31 بند 4) لتقر إعفاء السيارات ووسائل النقل الفردية المخصصة لاستخدام الأشخاص ذوي الإعاقة من الضريبة الجمركية وضريبة القيمة المضافة، على أن يكون الإعفاء لسيارة أو وسيلة واحدة كل 15 عامًا ويشترط أن يكون المستورد شخصًا ذا إعاقة، قاصرًا أو بالغًا، وأن تُستخدم الوسيلة للاستعمال الشخصي، سواء بقيادته أو بقيادة سائقه الشخصي المؤمن عليه، أو أحد أقاربه من الدرجة الأولى، أو الوصي إذا كان قاصرًا.
كما نص القانون على:
سداد قيمة السيارة أو جزء منها من الحساب الشخصي أو من أحد الأقارب من الدرجة الأولى.
عدم التصرف في السيارة خلال 5 سنوات من تاريخ الإفراج الجمركي.
في حالة وفاة صاحب الإعاقة قبل انقضاء المدة، يحق للورثة التصرف بعد سداد نصف الضريبة الجمركية وضريبة القيمة المضافة.
عقوبات مشددة على التزوير والانتحال
تضمن مشروع القانون تعديل المادة (49) لفرض عقوبة السجن حتى 10 سنوات وغرامة من 10 آلاف إلى 100 ألف جنيه لكل من يزور بطاقة إثبات الإعاقة أو شهادة التأهيل أو يستعملهما مع العلم بالتزوير، أو يدلي ببيانات كاذبة للاستفادة من المزايا المقررة كما نص تعديل المادة (51) على الحبس مدة لا تقل عن 6 أشهر وغرامة من 50 ألف إلى 200 ألف جنيه لكل من ينتحل صفة شخص ذي إعاقة أو يحصل على المزايا المقررة دون استحقاق، مع إلزامه برد ما حصل عليه دون وجه حق، مع عدم الإضرار بحقوق الغير حسن النية، وتهدف هذه التعديلات إلى ضمان وصول الحقوق والمزايا إلى مستحقيها الفعليين من الأشخاص ذوي الإعاقة، والحد من حالات التلاعب أو إساءة استخدام الامتيازات، بجانب تسهيل حصول المستحقين على إعفاءات ضريبية وجمركية حقيقية تساعدهم على تيسير حياتهم اليومية.
