الحقوق الصحية للأشخاص ذوي الإعاقة وفقًا للقانون المصري رقم 10 لسنة 2018.. تُعد فئة الأشخاص ذوي الإعاقة من أكثر الفئات التي حظيت باهتمام خاص في التشريعات والدساتير على مستوى العالم، وفي مقدمتها الدساتير المصرية التي نصّت على حقوقهم بشكل واضح وصريح، مؤكدّة أنهم جزء لا يتجزأ من نسيج المجتمع، ويستحقون الرعاية والحماية والدمج الكامل.
وجاء قانون رقم 10 لسنة 2018 ليعزز هذا التوجه من خلال تنظيم شامل لحقوق الأشخاص ذوي الإعاقة، لا سيما في الباب الثاني الخاص بالحقوق الصحية، وخصص له عدة مواد تهدف إلى ضمان حصولهم على خدمات صحية عادلة ومتكاملة.
بطاقة إثبات الإعاقة والخدمات المتكاملة (المادة 5)
نصّت المادة (5) على أن تقوم وزارة التضامن الاجتماعي بالتنسيق مع وزارة الصحة بإصدار بطاقة رسمية لكل شخص من ذوي الإعاقة، تُعرف باسم “بطاقة إثبات الإعاقة والخدمات المتكاملة”، وتُعد له ملفًا صحيًا معتمدًا بناءً على تشخيص طبي دقيق.

قاعدة بيانات وطنية للأشخاص ذوي الإعاقة (المادة 6)
ألزمت المادة (6) وزارة الصحة بالتعاون مع وزارة التضامن الاجتماعي والمجلس القومي لشؤون الإعاقة بإنشاء قاعدة بيانات مركزية خاصة بالأشخاص ذوي الإعاقة، تُستخدم هذه القاعدة لأغراض:
- التخطيط الصحي.
- متابعة تقديم الخدمات.
- ضمان الخصوصية وسرية البيانات.
الوقاية والتدخل المبكر والخدمات العلاجية (المادة 7)
تناولت المادة (7) الالتزامات الحكومية في مجال الوقاية والعلاج والتأهيل، وجاءت على النحو التالي:

وضع معايير طبية وتوفير كوادر متخصصة (المادة 8)
أوجبت المادة (8) على الجهات الصحية المختصة وضع معايير قياسية واضحة لعلاج وتأهيل الأشخاص ذوي الإعاقة، وشملت:
- تجهيز مراكز صحية متخصصة للتشخيص والعلاج.
- توفير أطقم طبية وفنية مدربة.
- ضمان جودة الأدوية والأغذية العلاجية.
- توفير أجهزة تعويضية ووسائل مساعدة بمواصفات دقيقة.
الإعفاء من رسوم القومسيون الطبي (المادة 9)
نصت المادة (9) على إعفاء الأشخاص ذوي الإعاقة من جميع الرسوم الخاصة بالقومسيون الطبي، سواء عند الكشف الأول أو عند استبدال سياراتهم المعفاة من الضرائب والرسوم الجمركية. كما شملت التعديلات:
