يعد القانون رقم 10 لسنة 2018 بشأن حقوق الأشخاص ذوي الإعاقة من أبرز التشريعات التي وضعتها الدولة المصرية لضمان حماية هذه الفئة، حيث يتضمن مجموعة شاملة من الحقوق التي تستهدف تحقيق الدمج الكامل في المجتمع، وتوفير بيئة آمنة تحفظ كرامتهم الإنسانية وتكفل حصولهم على كافة مستحقاتهم دون تمييز.
ويؤكد القانون على ضرورة صون حقوق ذوي القدرات الخاصة، مع وضع ضوابط قانونية صارمة تجرّم أي انتهاك أو إساءة قد يتعرضون لها، في إطار تعزيز مبادئ العدالة والمساواة داخل المجتمع.
عقوبات رادعة لمن يعرض ذوي الإعاقة للخطر
نص القانون على فرض عقوبات مشددة ضد كل من يتسبب في تعريض الأشخاص أو الأطفال ذوي الإعاقة للخطر أو المساس بكرامتهم، حيث تصل العقوبة إلى الحبس لمدة لا تقل عن 6 أشهر، بالإضافة إلى غرامة مالية تبدأ من 5 آلاف جنيه وقد تصل إلى 50 ألف جنيه، وذلك في إطار الردع القانوني وحماية الفئات الأكثر احتياجًا.
حالات اعتبار ذوي الإعاقة في خطر وفق القانون
حدد القانون في مادته رقم 46 الحالات التي يُعد فيها الشخص ذو الإعاقة معرضًا للخطر، والتي تمثل انتهاكًا صريحًا لحقوقه، وتشمل عددًا من الصور التي تستوجب التدخل القانوني الفوري:
تهديد الأمن والصحة والحياة
يُعد الشخص في خطر إذا تعرض أمنه أو صحته أو أخلاقه أو حياته لأي تهديد مباشر أو غير مباشر، بما يؤثر على سلامته الجسدية أو النفسية.
الحبس أو العزل دون سند قانوني
يحظر القانون حبس أو عزل الأشخاص ذوي الإعاقة عن المجتمع دون مبرر قانوني، كما يجرّم الامتناع عن تقديم الرعاية الطبية أو التأهيلية أو المجتمعية أو القانونية اللازمة لهم.
العنف والإساءة داخل المؤسسات
يشمل ذلك كافة أشكال الاعتداء، سواء بالضرب أو الإيذاء النفسي أو التهديد أو الاستغلال، خاصة داخل دور الرعاية أو الحضانات أو المؤسسات التعليمية، إضافة إلى الجرائم الأكثر خطورة مثل الاعتداء الجنسي.
التجارب الطبية غير القانونية
يمنع القانون إجراء أي تجارب أو استخدام وسائل علاجية قد تضر بالشخص ذو الإعاقة دون وجود سند قانوني واضح، حفاظًا على سلامته وحقوقه.
عدم تهيئة البيئة التعليمية
من الحالات التي تُعد خطرًا أيضًا، وجود الطلاب ذوي الإعاقة في أدوار مرتفعة داخل المدارس دون توفير وسائل الإتاحة المناسبة، بما يعرضهم لمخاطر يومية.
الإهمال الصحي والغذائي
يشدد القانون على ضرورة توفير العلاج اللازم والرعاية الصحية، خاصة للأطفال ذوي الإعاقة الذهنية، بما في ذلك توفير الأنظمة الغذائية المناسبة للحالات الخاصة مثل اضطرابات التمثيل الغذائي.
غياب التهيئة في بيئة العمل
يلزم القانون جهات العمل بتوفير بيئة مناسبة وآمنة للأشخاص ذوي الإعاقة، مع حظر تعريضهم لأي شكل من أشكال العنف أو الإهانة أو التمييز أو التحريض على الكراهية.
تعزيز الدمج المجتمعي وحماية الحقوق
يأتي هذا القانون في إطار رؤية الدولة لتحقيق الدمج المجتمعي الكامل للأشخاص ذوي الإعاقة، من خلال توفير الحماية القانونية، وضمان تكافؤ الفرص، وتحقيق العدالة الاجتماعية، بما يسهم في تمكينهم من المشاركة الفعالة في مختلف مجالات الحياة.
